Roundtable on judicial practice in enforcement procedure

The round table was attended by Assistant Justice Minister Jelena Deretić, Nikola Bodiroga, associate professor at the University of Belgrade’s Faculty of Law, Mladen Nikolić, a judge at the Commercial Court of Appeals, Nikola Stošić, a judge at the First Basic Court in Belgrade, and Tatjana Matković and Predrag Trifunović, both judges at the Supreme Court of Cassation. Moderating the discussion was Vladimir Vesović from Raiffeisen Bank, Chairman of AmCham’s Committee for Business and Commercial Law.
Representatives of AmCham member companies presented their views on enforcement and the problems they face every day in practice in this area. The most discussed subjects were objections and appeals against decisions on executions based on authentic documents, objections by third parties, changes of pledgor before the initiation of enforcement procedures, opportunities for execution of other judgment debtor matters, the right of pre-emption of real estate, opportunities for execution of the share of a natural person or legal entity, the moment of acquisition of items purchased in enforcement proceedings, and opportunities for objection compensation in enforcement procedures.
Continued cooperation and dialogue between the economy and the judiciary is planned for autumn 2019, with topics including bankruptcy and tax law, property-legal relations, illegal trade and the protection of intellectual property rights, as well as civil proceedings.
