AINSIGHTS: Artificial Intelligence in Legal Frameworks

Experts in the fields of law and technology recently held the third lecture in the Ainsights series, focusing on the application of artificial intelligence in legal frameworks.

The event was moderated by Prof. Dr. Đorđe Krvokapić, while the panelists, Dr. Andrea Radonjanin, Jelena Adamović, Milan Mirković, and Vladimir Trkulja, discussed aspects of technological standards, regulatory approaches, and legal principles crucial to this domain.

 

The discussion revolved around legal aspects closely tied to the development and implementation of artificial intelligence. Insights were shared on what companies need to prepare for the integration of artificial intelligence into their business processes.

 

Among the regulatory options for managing artificial intelligence, four key approaches were highlighted:

 

  1. Ethical Codes and Co-Regulation: Ethical codes set behavior standards, while co-regulation facilitates collaboration between the private sector and regulatory bodies to ensure consistent implementation of standards.
  2. “Ad-hoc” Sectoral Approach: Managing artificial intelligence through sectoral approaches allows adaptation to the specific needs of different industries.
  3. Horizontal Risk-Based Approach: This methodology explores various aspects of technology, identifies potential risks, and applies appropriate measures to preserve safety and ethics.
  4. Mandatory Requirements for All AI Systems: Based on setting standards that all systems must meet, including transparency, security measures, and adherence to privacy principles, creating unified guidelines ensuring a high level of responsibility.

 

Privacy and data protection issues are becoming increasingly important with the growing presence of artificial intelligence in people’s lives and corporate operations. To effectively address new risks in the context of data protection and privacy, several key approaches and methodologies can be applied:

 

  1. Integrating Privacy in Early Stages: Including privacy considerations in the design and development of systems and processes.
  2. Impact Assessment: Conducting Data Protection Impact Assessments (DPIA) to evaluate the impact of data processing activities and identify and mitigate potential risks.
  3. Implementation of Appropriate Measures: Adopting “reasonable” technical and organizational measures to protect personal data, taking into account the specific context of data processing.
